In this 15 credit module, students will deepen their understanding of the some of the themes addressed in Jurisprudence I. In particular they will continue their examination of the contest between positivism on the one hand and natural law and interpretive theories on the other by looking at the theories implications for a practical issue of great current importance: the legitimacy of rights-based judicial review of legislation. The module will also develop further the analysis of laws relationship with power, and what this means for democracy. This will involve a more advanced reading of the critical literatures on laws ideological function, and a continued exploration of how power combines with knowledge and language in our understanding of law.
